Welcome!

These User Terms of Service (“Terms”) govern your personal use of the Orgo platform (the “Service”) as a member, volunteer, beneficiary, supporter, or participant in an organization’s Orgo space.

By clicking “I Agree,” creating a user account, or accessing an organization’s Orgo space, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.


IMPORTANT: Who Are These Terms For?

These User Terms are for YOU - individual people who join and participate in organizations using Orgo (members, volunteers, beneficiaries, event attendees, supporters, etc.).

These Terms are NOT for organizations. If you are an organization subscribing to Orgo, please see our Organization Terms of Service.

The Relationship:

  • Your Organization invited you to use Orgo and controls your access to their Orgo space
  • Orgo provides the platform and technology
  • You use the platform to connect with your organization and other members

1. KEY DEFINITIONS

1.1 Basic Terms

  • “Service” or “Orgo”: The Orgo platform (website, mobile apps, and related services) that you access through your organization.
  • “Organization”: The entity that invited you to join their Orgo space (e.g., your non-profit, association, club, school, community group, etc.).
  • “Account”: Your personal user account within your Organization’s Orgo space.
  • “Content”: Text, images, videos, documents, comments, posts, messages, and other materials you create, upload, or share on the Service.
  • “Personal Data”: Information about you (name, email, profile information, activity, etc.).

2. ELIGIBILITY & ACCOUNT CREATION

2.1 Age Requirements

To use the Service, you must be:

  • (a) At least 14 years old in most countries.
  • (b) At least 16 years old if you are in the European Union or European Economic Area (without parental consent).
  • (c) At least 13 years old in the United States (if you are under 13, your parent or guardian must create your account and consent to your use of the Service under COPPA).

If you are under the applicable age, you may only use the Service if:

  • Your parent or legal guardian has created your account and provided verifiable parental consent
  • Your Organization has implemented appropriate safeguarding measures for children
  • You use the Service under the supervision of a parent, guardian, or your Organization’s administrators

2.2 Account Creation

2.2.1 How Accounts Are Created

Your Account may be created:

  • By you - When you sign up or register for your Organization’s Orgo space
  • By your Organization - Your Organization may create an account for you (e.g., when you become a member, volunteer, or beneficiary)
  • Via social login - By connecting your Google, Microsoft, Apple, or LinkedIn account

2.2.2 Your Responsibilities

When you create or receive an Account, you agree to:

  • Provide accurate and truthful information
  • Keep your password secure and confidential
  • Not share your Account with anyone
  • Notify your Organization or Orgo immediately if your Account is compromised (email: security@orgo.space)
  • Accept that you are responsible for all activities that occur under your Account

2.3 Your Organization Controls Your Account

Important: Your Account exists within your Organization’s Orgo space. This means:

  • (a) Your Organization invited you and can manage your Account (update your profile, change your role, suspend or delete your Account).
  • (b) Your Organization is the Data Controller for your Personal Data within their Orgo space (they decide how your data is used, stored, and shared).
  • (c) Orgo is the Data Processor - We process your data on behalf of your Organization according to their instructions and our Data Processing Agreement.
  • (d) If you leave the Organization or your membership ends, your Organization may delete your Account and data.
  • (e) For questions about your data, contact your Organization first. If unresolved, contact Orgo at privacy@orgo.space.

2.4 You Cannot Create Fake or Multiple Accounts

You may not:

  • Create fake, fraudulent, or misleading accounts
  • Impersonate another person or entity
  • Create multiple accounts to evade bans, manipulate engagement, or spam
  • Use someone else’s account or share your account with others

3. ACCEPTABLE USE POLICY

3.1 Permitted Uses

You may use the Service to:

  • Participate in your Organization’s community (discussions, events, activities)
  • Connect with other members, volunteers, and supporters
  • Receive communications from your Organization
  • Register for events, donate, pay membership fees
  • Access content, documents, and resources shared by your Organization
  • Use features provided by your Organization (groups, discussions, tasks, courses, etc.)

3.2 Prohibited Uses

You agree NOT to use the Service to:

3.2.1 Illegal or Harmful Activities

  • (a) Violate any law or regulation.
  • (b) Distribute illegal content (child exploitation material, terrorist content, etc.).
  • (c) Engage in fraud, phishing, scams, or financial crimes.
  • (d) Harass, stalk, threaten, bully, or incite violence against individuals or groups.
  • (e) Promote discrimination based on race, religion, gender, sexual orientation, disability, age, or other protected characteristics.

3.2.2 Spam & Unsolicited Communications

  • (a) Send unsolicited bulk messages (spam) to other members.
  • (b) Use the Service’s messaging features for commercial advertising unrelated to your Organization (unless your Organization permits it).
  • (c) Scrape email addresses or contact information of other members for external use.

3.2.3 Intellectual Property Infringement

  • (a) Upload or share content that infringes third-party copyrights, trademarks, patents, or trade secrets.
  • (b) Impersonate another person, organization, or brand.
  • (c) Use copyrighted images, videos, music, or text without permission.
  • (d) Violate the Digital Millennium Copyright Act (DMCA) or equivalent laws in your jurisdiction.

3.2.4 Security & System Abuse

  • (a) Attempt to gain unauthorized access to the Service, other members’ accounts, your Organization’s account, or Orgo’s systems.
  • (b) Reverse engineer, decompile, or disassemble the Service.
  • (c) Use bots, scrapers, or automated tools to extract data (except via documented APIs with authorization).
  • (d) Perform security testing (penetration testing, vulnerability scanning) without Orgo’s prior written consent (contact security@orgo.space).
  • (e) Introduce viruses, malware, ransomware, worms, trojan horses, or harmful code.
  • (f) Overload or disrupt the Service (e.g., denial-of-service attacks, excessive API calls).

3.2.5 AI Training, Data Mining, and Automated Scraping

  • (a) Use Content accessible through the Service to develop, train, fine-tune, or improve machine learning models, artificial intelligence systems, large language models (LLMs), neural networks, or algorithmic prediction tools without explicit written consent from the content owner and Orgo.
  • (b) Use robots, spiders, web crawlers, scrapers, automated scripts, headless browsers, or any manual or automated data extraction techniques to harvest, collect, mine, aggregate, or index content, data, or information from the Service.
  • (c) Circumvent technical measures designed to prevent automated access, including rate limits, CAPTCHA, or authentication mechanisms.

3.2.6 Prohibited Content

You may not post, upload, or share:

  • (a) Explicit or Adult Content (unless your Organization explicitly permits it and you are of legal age):
    • Pornography or sexually explicit material
    • Nudity or sexual content involving minors (strictly prohibited)
  • (b) Violent or Disturbing Content:
    • Graphic violence, gore, or disturbing imagery
    • Content that glorifies or encourages violence
  • (c) Hateful or Discriminatory Content:
    • Content that promotes hatred, violence, or discrimination against individuals or groups
  • (d) Misinformation or Harmful Content:
    • Deliberate misinformation or disinformation intended to deceive or harm
    • Health misinformation that could cause physical harm
  • (e) Private or Confidential Information:
    • Other members’ personal information (doxxing)
    • Confidential or proprietary information without authorization
    • Payment information (credit card numbers, bank details, etc.)

3.3 Your Organization’s Additional Rules

Your Organization may have additional rules, codes of conduct, or community guidelines for their Orgo space. You agree to comply with those rules as well. Your Organization can enforce those rules by:

  • Removing your Content
  • Suspending or restricting your Account
  • Terminating your access to their Orgo space

3.4 Enforcement

If you violate this Acceptable Use Policy:

(a) Your Organization may:

  • Warn you
  • Remove your Content
  • Suspend or restrict your Account
  • Terminate your access to their Orgo space

(b) Orgo may (independently or at your Organization’s request):

  • Warn you
  • Remove your Content
  • Suspend or terminate your Account across all Orgo spaces (if you pose a platform-wide risk)
  • Report you to law enforcement if your conduct is illegal

(c) No refunds: If you paid for membership, events, or donations through the Service, violations of this Policy do not entitle you to refunds.

3.5 Reporting Violations

If you see content or conduct that violates this Policy:

  • Report to your Organization (they have tools to moderate content and users)
  • Report to Orgo at abuse@orgo.space (for serious violations like illegal content, security threats, or platform-wide abuse)

4. YOUR CONTENT

4.1 Ownership of Your Content

You retain all ownership rights to Content you create, upload, or share on the Service.

4.2 License to Orgo and Your Organization

By posting Content on the Service, you grant:

4.2.1 License to Your Organization

A non-exclusive, royalty-free, worldwide license to:

  • Display your Content within their Orgo space
  • Share your Content with other members of the Organization
  • Use your Content for the Organization’s legitimate purposes (community management, event promotion, newsletters, etc.)
  • Store and archive your Content as needed for organizational records

4.2.2 License to Orgo

A non-exclusive, royalty-free, worldwide, sublicensable license to:

  • Display your Content to you, your Organization, and other authorized members
  • Store and back up your Content on our servers
  • Process your Content to provide the Service (e.g., resizing images, generating thumbnails, indexing for search)
  • Use your Content in aggregated, anonymized form for analytics and service improvement (as described in our Privacy Policy)

4.3 Your Content Responsibilities

You represent and warrant that:

  • (a) You own or have the necessary rights to all Content you post.
  • (b) Your Content does not violate third-party intellectual property rights (copyrights, trademarks, patents, trade secrets).
  • (c) Your Content does not violate anyone’s privacy, publicity, or other legal rights.
  • (d) Your Content complies with this Acceptable Use Policy (Section 3).
  • (e) Your Content complies with applicable laws (defamation, obscenity, hate speech laws, etc.).

4.4 Content Moderation

4.4.1 Your Organization’s Rights

Your Organization has the right to:

  • Review, moderate, or remove any Content you post in their Orgo space
  • Set rules for what Content is acceptable
  • Enforce community guidelines

4.4.2 Orgo’s Rights

Orgo has the right (but not the obligation) to:

  • Remove Content that violates these Terms or applicable law
  • Remove Content that poses security or legal risks
  • Suspend or terminate accounts that repeatedly violate policies
  • Investigate suspected violations

4.5.1 If You Believe Your Copyright Was Infringed

If you believe Content on the Service infringes your copyright, send a DMCA takedown notice to dmca@orgo.space with:

  • Your contact information (name, email, address, phone)
  • Identification of the copyrighted work you claim was infringed
  • Identification of the infringing Content (URL or description)
  • A statement that you have a good faith belief the use is not authorized
  • A statement that the information in your notice is accurate and, under penalty of perjury, you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

4.6 Backup and Deletion

(a) We are not a backup service: While we maintain backups for disaster recovery, you should keep your own copies of important Content.

(b) Deletion: If you delete Content or your Account is deleted:

  • Content may be removed immediately from public view
  • Content may remain in backups for up to 90 days
  • Some Content may be retained longer if required by law or your Organization’s retention policies

5. PRIVACY & DATA PROTECTION

5.1 Who Controls Your Data?

Your Organization is the Data Controller for your Personal Data within their Orgo space. This means:

  • Your Organization decides how your data is collected, used, stored, and shared
  • Your Organization is responsible for complying with privacy laws (GDPR, CCPA, etc.)
  • Your Organization must provide you with a privacy notice explaining how they use your data

Orgo is the Data Processor, which means:

  • We process your data on behalf of your Organization according to their instructions
  • We implement security measures to protect your data
  • We assist your Organization in responding to your privacy rights requests

5.2 What Data Do We Collect?

From You:

  • Profile information (name, email, phone, photo, bio, location)
  • Account credentials (username, password)
  • Content you create (posts, comments, messages, documents, images, videos)
  • Payment information (if you pay membership fees or donate via third-party payment processors)
  • Communications (messages to other members, support tickets)

Automatically:

  • Device information (IP address, browser type, operating system)
  • Usage information (pages visited, features used, time spent)
  • Location data (approximate from IP address; precise GPS if you enable location services in the mobile app)
  • Cookies and similar technologies (see Section 5.7)

5.3 How Do We Use Your Data?

On Behalf of Your Organization:

  • Provide the Service to you (account management, content delivery, communication)
  • Enable your participation in your Organization’s activities (events, discussions, tasks, etc.)
  • Process payments and donations (via third-party payment processors)
  • Send you notifications about your Organization’s activities
  • Provide customer support

For Orgo’s Legitimate Interests:

  • Improve the Service (analyze usage patterns, develop new features)
  • Ensure security and prevent fraud
  • Comply with legal obligations (tax reporting, law enforcement requests)
  • Aggregate and anonymize data for analytics and research

5.4 How Do We Share Your Data?

Within Your Organization:

  • Your profile information is visible to your Organization’s administrators
  • Your Content is visible to other members (depending on your Organization’s privacy settings)
  • Your activity and engagement data is visible to your Organization (for analytics and management)

With Third-Party Service Providers (on behalf of your Organization):

  • AWS (cloud hosting - data stored in Frankfurt, Germany for EU users)
  • Payment Processors (e.g., Stripe, PayPal) (payment processing - they do NOT share your full payment details with us or your Organization)
  • Plausible Analytics (privacy-focused analytics - no personal data tracking, GDPR-compliant)
  • Email/SMS providers (to send transactional messages)

We Do NOT Sell Your Data:

  • Orgo does NOT sell, rent, or trade your personal data to data brokers, advertisers, or marketing companies
  • We do NOT display advertisements or monetize your data through ad networks
  • Our revenue comes from subscriptions paid by organizations, not from your data

5.5 Your Privacy Rights

Depending on where you live, you may have the following rights:

GDPR (EU/EEA/UK):

  • Access: Request a copy of your Personal Data
  • Rectification: Correct inaccurate data
  • Erasure: Request deletion of your data (“right to be forgotten”)
  • Restriction: Restrict certain processing of your data
  • Portability: Receive your data in a portable format
  • Object: Object to processing based on legitimate interests
  • Withdraw consent: Withdraw consent you previously gave

CCPA/CPRA (California):

  • Know: Request information about data collected, used, and shared
  • Access: Request a copy of your data
  • Delete: Request deletion of your data
  • Opt-out: Opt-out of “sale” or “sharing” of your data
  • Non-discrimination: We won’t discriminate against you for exercising your rights

How to Exercise Your Rights:

  1. Contact Your Organization First: Since your Organization is the Data Controller, contact them directly for most requests (access, correction, deletion of data they control).
  2. Contact Orgo If Unresolved: If your Organization doesn’t respond or you want to exercise rights against Orgo directly, contact privacy@orgo.space.
  3. Response Time:
    • GDPR: We’ll respond within 30 days
    • CCPA: We’ll respond within 45 days

5.6 Data Retention

While Your Account is Active:

  • We retain your data for as long as your Account exists and as needed to provide the Service

After You Delete Your Account or Leave the Organization:

  • Most data is deleted within 90 days
  • Some data may be retained longer for legal or operational reasons:
    • Transaction records (10 years for accounting)
    • Fraud prevention logs (5 years)
    • Backup systems (up to 90 days)

If Your Organization Deletes Their Account:

5.7 Cookies and Tracking

What Are Cookies? Cookies are small text files stored on your device that help websites function and analyze usage.

Cookies We Use:

Essential Cookies (always active):

  • Authentication and session management
  • Security and fraud prevention
  • Remember your preferences

Analytics Cookies:

  • Plausible Analytics: Privacy-focused, GDPR-compliant (no personal data tracking, no cookies)

Managing Cookies:

  • Adjust cookie settings in your browser
  • Note: Blocking essential cookies may prevent you from using the Service

5.8 Children’s Privacy

If you are under 13 (US), under 16 (EU), or under 18 (in jurisdictions with stricter rules):

  • (a) Parental Consent Required: Your parent or guardian must provide consent before you use the Service.
  • (b) Organization’s Responsibility: Your Organization must implement appropriate safeguarding measures and obtain verifiable parental consent as required by COPPA (US), GDPR Article 8 (EU), or local law.
  • (c) Parents’ Rights: Your parent or guardian may:
    • Access your data
    • Request correction or deletion
    • Withdraw consent
    • Contact your Organization or Orgo at privacy@orgo.space

5.9 International Data Transfers

Data Storage:

  • EU Users: Data is stored in AWS Frankfurt, Germany (EU)
  • US Users: Data may be stored in AWS US regions (when available)

Transfers Outside the EU: If your data is transferred outside the EU/EEA (e.g., to service providers in the US), Orgo uses:

  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Supplementary measures (encryption, access controls)
  • Transfer Impact Assessments

6. PAYMENTS & TRANSACTIONS

6.1 Payments to Your Organization

You may pay membership fees, event tickets, donations, or other charges to your Organization through the Service.

Important:

  • You are paying your Organization, not Orgo (Orgo just provides the payment processing technology)
  • Your Organization determines prices, refund policies, and payment terms
  • Orgo is not a party to the transaction between you and your Organization

6.2 Payment Processing

Payments are processed by third-party payment processors (such as Stripe, PayPal, or others). When you make a payment:

  • (a) The payment processor collects your payment information (credit card number, billing address).
  • (b) The payment processor processes the payment securely (Orgo does NOT store your full credit card number).
  • (c) The payment processor transfers funds to your Organization (minus payment processing fees).
  • (d) The payment processor’s Terms of Service and Privacy Policy apply to payment processing.

6.3 Refunds

Refunds are your Organization’s responsibility, not Orgo’s. If you want a refund:

  • (a) Contact your Organization directly (they decide whether to issue refunds).
  • (b) Your Organization can process refunds via the payment processor.
  • (c) Orgo cannot issue refunds on behalf of your Organization.

6.4 Transaction Disputes

If you dispute a charge with your bank or credit card company (chargeback):

  • (a) Your Organization is responsible for responding to the dispute.
  • (b) Orgo may assist your Organization with documentation.
  • (c) If the chargeback is resolved in your favor, your bank/credit card company will refund you.
  • (d) If you initiate fraudulent chargebacks, your Organization or Orgo may suspend or terminate your Account.

6.5 Payment Information Security

  • (a) Orgo does NOT store your full credit card number (the payment processor does).
  • (b) Orgo stores only:
    • Last 4 digits of your card (for display purposes)
    • Transaction amounts, dates, and status
  • (c) You should:
    • Keep your payment information secure
    • Review statements regularly
    • Report unauthorized charges to your bank/credit card company and your Organization

Your Organization may share links to external websites (social media, YouTube, partner sites, etc.). These websites are not controlled by Orgo or your Organization.

Important:

  • Review external sites’ privacy policies and terms before using them
  • Orgo is not responsible for external sites’ content, accuracy, or practices
  • Links do not imply endorsement

7.2 Embedded Content

Your Organization or other members may embed content from third parties (YouTube videos, social media posts, etc.). Such content is governed by the third party’s terms and policies.

7.3 Social Media Sharing

If you share Orgo content to social media (Facebook, Twitter, LinkedIn):

  • The social media platform’s privacy policy governs how your information is used
  • Orgo is not responsible for how social media platforms process your data

8. MOBILE APPLICATIONS

8.1 App Availability

Orgo offers mobile apps for iOS (Apple App Store) and Android (Google Play Store).

8.2 App Store Terms

Your download and use of the mobile app is also governed by:

The mobile app may request permissions to access:

  • Camera: To upload photos or scan QR codes
  • Microphone: To record audio or participate in livestreams
  • Location: To find nearby events or check in (only if you enable this feature)
  • Photo library: To upload images
  • Notifications: To receive push notifications about your Organization’s activities

You can manage permissions in your device settings: Settings > Apps > Orgo > Permissions

8.4 Push Notifications

The app may send push notifications about:

  • New messages or comments
  • Upcoming events
  • Tasks assigned to you
  • Your Organization’s announcements

You can disable push notifications in:

  • Your device settings: Settings > Apps > Orgo > Notifications
  • The app settings: App > Settings > Notifications

8.5 Updates

We may release updates to the mobile app for:

  • New features
  • Bug fixes
  • Security improvements
  • Compatibility with new OS versions

You should keep the app updated to ensure security and optimal performance.

8.6 App Suspension or Removal

Orgo reserves the right to:

  • Suspend or remove the app from app stores
  • Discontinue app support for certain devices or OS versions (with reasonable notice)

9. DISCLAIMERS & LIMITATIONS

9.1 “AS IS” Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

(a) Implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

(b) No guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses.

(c) No guarantee of results, outcomes, or specific functionality.

(d) No guarantee that your Organization will operate the Service properly or treat you fairly.

9.2 Your Organization’s Conduct

ORGO IS NOT RESPONSIBLE FOR:

(a) Your Organization’s actions or decisions (removing your Account, misusing your data, enforcing unfair policies).

(b) Disputes between you and your Organization.

(c) Your Organization’s failure to comply with privacy laws or these Terms.

(d) Your Organization’s failure to provide refunds or respond to your requests.

If you have issues with your Organization, contact them directly.

9.3 Other Members’ Conduct

ORGO IS NOT RESPONSIBLE FOR:

(a) Content posted by other members (inaccurate, offensive, harmful, or illegal content).

(b) Other members’ conduct (harassment, bullying, fraud, scams).

(c) Disputes between you and other members.

Report violations to your Organization or Orgo at abuse@orgo.space (Section 3.5).

9.4 Third-Party Services

ORGO IS NOT RESPONSIBLE FOR:

(a) Third-party payment processors (Stripe, PayPal, etc.).

(b) Third-party integrations enabled by your Organization (HubSpot, Google Tag Manager, etc.).

(c) Social login providers (Google, Microsoft, Apple, LinkedIn).

(d) External websites linked from the Service.

9.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) ORGO’S TOTAL LIABILITY TO YOU SHALL NOT EXCEED €100 (since you do not pay Orgo directly; your Organization does).

(b) ORGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of data or content
  • Loss of opportunity or reputation
  • Emotional distress
  • Business interruption
  • Loss of profits or revenue

(c) EXCEPTIONS: These limitations do not apply to:

  • Fraud or fraudulent misrepresentation by Orgo
  • Gross negligence or willful misconduct by Orgo
  • Personal injury or death caused by Orgo’s negligence
  • Liability that cannot be excluded under applicable law (e.g., certain consumer protection laws)

9.6 Your Sole Remedy

Your sole remedy for any issue with the Service is to:

  • Stop using the Service
  • Request deletion of your Account (contact your Organization or Orgo at privacy@orgo.space)

10. INDEMNIFICATION

10.1 Your Indemnification of Orgo

You agree to indemnify, defend, and hold harmless Orgo, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from:

(a) Your use of the Service in violation of these Terms or applicable law.

(b) Your Content, including claims that your Content infringes third-party intellectual property rights, violates privacy rights, or is defamatory.

(c) Your conduct, including harassment, fraud, scams, or illegal activity.

(d) Your violation of the Acceptable Use Policy (Section 3).

(e) Your violation of third-party rights (other members, your Organization, external parties).

10.2 Procedure

If Orgo receives a claim that you are responsible for:

  • Orgo will notify you promptly
  • You will cooperate with Orgo in defending the claim
  • Orgo may control the defense and settlement (or allow you to defend if you agree to indemnify Orgo fully)

11. TERMINATION

11.1 Your Right to Terminate

You may delete your Account at any time:

(a) Via Account Settings (if your Organization allows self-deletion).

(b) Contact Your Organization to request Account deletion.

(c) Contact Orgo at privacy@orgo.space if your Organization is unresponsive.

Effect:

  • You lose access to the Service and your Organization’s Orgo space
  • Your Content is deleted or anonymized (per your Organization’s retention policies)
  • You may lose access to Content you created (download/export it before deleting your Account)

11.2 Your Organization’s Right to Terminate

Your Organization may suspend or terminate your Account at any time if:

  • You violate their rules or community guidelines
  • Your membership, volunteering, or participation ends
  • You request Account deletion
  • They believe it’s in the Organization’s best interest

11.3 Orgo’s Right to Terminate

Orgo may suspend or terminate your Account if:

(a) You violate these Terms or the Acceptable Use Policy (Section 3).

(b) You pose a security or legal risk to the Service or other users.

(c) You engage in fraud, abuse, or illegal activity.

(d) Required by law or court order.

(e) Your Organization’s Account is terminated (all user accounts within that Organization are deleted).

11.4 Effect of Termination

Upon termination:

(a) You immediately lose access to the Service.

(b) Your Content may be deleted or anonymized (per Section 4.6).

(c) Some data may be retained for legal or operational reasons (Section 5.6).

(d) Sections that should survive termination remain in effect (Sections 4, 5, 9, 10, 11, 12).

11.5 No Refunds

If you paid membership fees, event tickets, or donations, termination does not entitle you to refunds (refunds are governed by your Organization’s policies).


12. DISPUTE RESOLUTION & GOVERNING LAW

12.1 Disputes with Your Organization

If you have a dispute with your Organization (refunds, data misuse, unfair treatment):

  • Resolve directly with your Organization first
  • Contact Orgo at privacy@orgo.space if it involves data protection violations
  • Orgo may facilitate resolution but is not responsible for your Organization’s conduct

12.2 Disputes with Orgo

If you have a dispute with Orgo:

(a) Informal Resolution First: Contact legal@orgo.space to attempt informal resolution within 30 days.

(b) Governing Law: These Terms are governed by the laws of Romania, without regard to conflict of laws principles.

(c) Jurisdiction: Any disputes shall be resolved in the courts of Ploiești, Romania (or Bucharest, Romania, if Ploiești courts decline jurisdiction).

(d) GDPR/Privacy Disputes: For data protection disputes, you may also:

  • File a complaint with your local data protection authority
  • EU/EEA: Your national supervisory authority
  • Romania: Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal (ANSPDCP)
  • California: California Attorney General

12.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT DISPUTES WITH ORGO WILL BE RESOLVED ON AN INDIVIDUAL BASIS, NOT AS PART OF A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

If this waiver is unenforceable in your jurisdiction, the remainder of this Section 12 remains in effect.

12.4 Time Limit for Claims

You must bring any claim against Orgo within one (1) year after the claim arose, or the claim is permanently barred.


13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Orgo regarding your use of the Service.

13.2 Amendments

13.2.1 Our Right to Amend

We may update these Terms from time to time to:

  • Reflect changes to the Service
  • Comply with legal requirements
  • Clarify terms or improve readability

13.2.2 Notice of Changes

We will notify you of material changes:

  • Via email to your account email address
  • Via in-app notification
  • By posting updated Terms at orgo.space/terms-user/ with the “Last Updated” date changed

13.2.3 Your Right to Object

If you object to material changes:

  • You may stop using the Service and delete your Account
  • Continued use after the effective date of changes constitutes acceptance

13.3 Severability

If any provision of these Terms is found to be invalid or unenforceable:

  • The provision will be modified to the minimum extent necessary to make it valid
  • If modification is not possible, it will be severed
  • The remaining provisions remain in full force and effect

13.4 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision. No waiver is effective unless in writing.

13.5 Assignment

You may not assign or transfer your rights under these Terms. Orgo may assign these Terms to an affiliate or successor entity.

13.6 No Third-Party Beneficiaries

These Terms are solely for your benefit and Orgo’s benefit. No third parties (including your Organization) have rights under these Terms.

13.7 Independent Relationship

You and Orgo are independent parties. These Terms do not create a partnership, employment, agency, or joint venture.

13.8 Force Majeure

Neither you nor Orgo is liable for failure to perform obligations due to events beyond reasonable control (natural disasters, wars, pandemics, government actions, internet outages, cyberattacks).

13.9 Language

These Terms are written in English. If translated, the English version prevails in case of conflict.

13.10 Electronic Signatures

Your electronic acceptance (clicking “I Agree” or creating an Account) constitutes a legally binding signature.

13.11 Relationship to Organization Terms

These User Terms govern your relationship with Orgo. Your Organization has separate Organization Terms of Service with Orgo that govern the Organization’s subscription and responsibilities.
